1. Introduction
This Privacy Policy describes how RadGen Media, LLC, a Pennsylvania limited liability company (“RadGen,” “we,” “us,” or “our”), collects, uses, and shares information in connection with the Radically Genuine Podcast website at https://radicallygenuine.com (the “Site”), our membership program, newsletters, community features, events, and related services (collectively, the “Services”). It should be read together with our Terms and Conditions.
By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.
2. Information We Collect
2.1 Information you provide to us
Account and membership information. Name or username, email address, password, membership tier, and plan selection when you create an account or subscribe.
Payment information. Payments are processed by third-party payment processors. We receive limited transaction information (such as the amount, plan, and last four digits of a card) but do not collect or store full payment card numbers.
Submissions and community content. Comments, questions submitted for Q&A sessions, content recommendations, poll responses, and other material you choose to post or submit. Please do not include health information or other sensitive personal information in submissions; they are not confidential and may be visible to other members or featured in content as described in our Terms and Conditions.
Event and retreat registration. Registration details for live events or retreats, which may include contact information and any information you choose to provide (for example, dietary preferences for an in-person event).
Communications. Information you provide when you contact us for support, respond to surveys, or correspond with us.
2.2 Information collected automatically
Usage data. Pages viewed, content played, links clicked, listening or viewing activity on the Site or membership platform, and interaction with newsletters (such as opens and clicks).
Device and log data. IP address, browser type, operating system, device identifiers, referring pages, and date/time stamps.
Cookies and similar technologies. We and our service providers use cookies, pixels, and similar technologies to operate the Site, remember preferences, keep you signed in, and understand how the Services are used. See Section 6.
2.3 Information from third parties
We may receive information from the platforms we use to deliver the Services — such as membership and subscription platforms, podcast hosting and analytics providers, email service providers, and payment processors — and from social media platforms if you interact with our accounts or content there.
3. How We Use Information
To provide the Services: deliver member content, process subscriptions and payments, manage accounts, run community features, and administer events and registrations.
To communicate with you: transactional messages (receipts, renewal notices, account and policy updates), newsletters, and — where permitted — marketing communications, which you can opt out of at any time.
To produce content: to review, select, and respond to member submissions and recommendations, including featuring them in episodes as described in our Terms and Conditions.
To improve the Services: understand usage, measure performance of content and campaigns, develop new features and offerings, and maintain security.
To comply with law and protect rights: enforce our Terms, detect and prevent fraud or abuse, and meet legal, accounting, and regulatory obligations.
We do not use information collected through the Services to provide medical or psychological advice, diagnosis, or treatment, and the Services are not designed to collect health information.
4. How We Share Information
Service providers. Vendors that perform services on our behalf — membership and subscription platforms, payment processors, email and newsletter providers, podcast hosting and analytics, website hosting, and event management — under obligations to use the information only to provide those services.
Featured content. If your submission or recommendation is featured in an episode, newsletter, or other content, we may identify you by the first name or username on your account, as described in the Terms and Conditions, unless you request otherwise.
Legal and safety. When required by law, subpoena, or legal process, or when we believe disclosure is reasonably necessary to protect the rights, property, or safety of RadGen, our members, or others.
Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or an equivalent successor policy.
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.
5. Email and Marketing Choices
If you join our free email list or become a member, we will send you the newsletter and updates about the show, membership, book, and events. You can unsubscribe from marketing emails at any time using the link in any message or by contacting us via the contact page linked at the bottom of our website. We will still send transactional messages related to your account or membership (such as receipts, renewal reminders, and policy notices) while your account is active.
6. Cookies and Analytics
We use essential cookies necessary for the Site to function (such as sign-in and session cookies) and analytics cookies that help us understand how visitors use the Site. You can control cookies through your browser settings; disabling certain cookies may affect Site functionality. Our Site does not currently respond to “Do Not Track” browser signals.
7. Data Retention
We retain personal information for as long as needed to provide the Services and for legitimate business purposes — such as maintaining your account and membership history, complying with legal, tax, and accounting obligations, resolving disputes, and enforcing agreements. Content in which a featured submission appears (such as a published episode) may be retained indefinitely as part of the published work. When information is no longer needed, we delete or de-identify it.
8. Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information, and we rely on reputable service providers for payment processing, membership management, and hosting. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please use a strong, unique password and keep your credentials confidential.
9. Your Privacy Rights
Depending on where you live, you may have rights under applicable privacy laws, which may include the right to access the personal information we hold about you, request correction or deletion, obtain a portable copy, and opt out of certain uses. To exercise any of these rights, contact us via the contact page linked at the bottom of our website. We will verify your request and respond within the time required by applicable law, and we will not discriminate against you for exercising your rights.
9.1 Residents of Pennsylvania
RadGen Media, LLC is based in Pennsylvania. As of the Effective Date, Pennsylvania has not enacted a comprehensive consumer data privacy statute; Pennsylvania residents are protected by Pennsylvania’s Breach of Personal Information Notification Act, 73 P.S. § 2301 et seq. (which requires us to notify affected residents of qualifying security breaches), and by applicable federal law. Legislation that would establish a Pennsylvania Consumer Data Privacy Act is pending in the General Assembly; if such a law is enacted, we will update this Policy to reflect its requirements. In the meantime, as a courtesy, we extend the rights described in this Section 9 to all of our U.S. members and Site visitors, including Pennsylvania residents, regardless of whether a state statute requires it.
9.2 Residents of California
This subsection supplements this Policy for California residents and is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”).
Categories of personal information we collect. In the preceding 12 months (or since launch of the Services, if shorter), we have collected the following categories of personal information, as described in Section 2: (a) identifiers (such as name or username, email address, and IP address); (b) commercial information (such as membership tier, transaction history, and event registrations); (c) internet or other electronic network activity information (such as pages viewed, content played, and newsletter interactions); (d) audio or visual information, only if you choose to submit it or participate in a recorded session; (e) inferences drawn from the foregoing (such as content preferences); and (f) sensitive personal information limited to account log-in credentials.
Sources, purposes, and disclosures. We collect these categories from the sources described in Section 2, use them for the business purposes described in Section 3, and disclose them for business purposes to the categories of service providers described in Section 4 (membership and subscription platforms, payment processors, email providers, hosting and analytics providers, and event management providers). We retain each category for the periods described in Section 7.
No sale or sharing. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined by the CCPA, and we have not done so in the preceding 12 months. We do not sell or share the personal information of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes other than those permitted by the CCPA (such as providing the Services and maintaining security), so we do not offer a “Limit the Use of My Sensitive Personal Information” option because none is required.
Your California rights. Subject to certain exceptions, California residents have the right to: (a) know and access the personal information we have collected about you, including the categories of information, sources, purposes, and the categories of third parties to whom it was disclosed; (b) delete personal information we collected from you; (c) correct inaccurate personal information; (d) receive a portable copy of your personal information; (e) opt out of sale or sharing (not applicable, as we do neither); and (f) not receive discriminatory treatment for exercising these rights.
Exercising your rights. You may exercise these rights by emailing [email protected] with the subject line “Privacy Rights Request” or by using any request mechanism offered on the Site. We will verify your identity by matching information you provide against information in our records (such as the email address associated with your account) and may request additional verification where necessary. You may designate an authorized agent to submit a request on your behalf; we will require proof of the agent’s authority and may require you to verify your own identity. We will respond within 45 days of receiving a verifiable request, and may extend that period by an additional 45 days where reasonably necessary, with notice to you.
9.3 Residents of Other States with Comprehensive Privacy Laws
If you reside in a state with a comprehensive consumer privacy law — including, without limitation, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Kentucky, Tennessee, Minnesota, Maryland, and Rhode Island — you may have the following rights with respect to your personal data, subject to the terms and exceptions of your state’s law: (a) to confirm whether we process your personal data and to access it; (b) to correct inaccuracies; (c) to delete personal data provided by or obtained about you; (d) to obtain a portable copy; and (e) to opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell personal data, do not process personal data for targeted advertising, and do not engage in such profiling; accordingly, there is currently nothing to opt out of, and universal opt-out preference signals (such as Global Privacy Control) do not change any processing we perform. We do not process sensitive data as defined by these laws except as you may voluntarily provide it, and we ask that you not submit sensitive information through the Services.
How to exercise these rights; appeals. Submit requests to [email protected] with the subject line “Privacy Rights Request.” We will authenticate your request and respond within 45 days, extendable by an additional 45 days where reasonably necessary, with notice to you. If we decline to act on your request, we will explain our reasons, and — where your state’s law provides an appeal right — you may appeal our decision by replying to our response or emailing [email protected] with the subject line “Privacy Appeal” within a reasonable period. We will respond to appeals within the period required by your state’s law (generally 45 to 60 days). If your appeal is denied, you may contact your state Attorney General to submit a complaint.
9.4 Nevada Residents
Nevada law permits Nevada residents to opt out of the sale of certain covered information. We do not sell covered information as defined by Nevada law; however, Nevada residents may submit a request to record their opt-out preference by emailing [email protected].
9.5 International Visitors
The Services are operated from the United States and intended for a U.S. audience, and information is processed and stored in the United States, where privacy laws may differ from those in your jurisdiction.
10. Children’s Privacy
The Services are intended for adults and are not directed to children. You must be at least 18 years old to create an account or purchase a membership. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us via the contact page linked at the bottom of our website and we will delete it.
11. Third-Party Platforms
The Services link to and operate through third-party platforms — including podcast directories, membership and payment platforms, video hosts, and social media. Those platforms collect and process information under their own privacy policies, which we do not control and encourage you to review. This Policy applies only to information we collect through the Services.
12. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will post the updated Policy on the Site with a new effective date and, where appropriate, notify active members by email or through the membership platform before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
