1. Agreement to These Terms
These Terms and Conditions (“Terms”) are a binding agreement between you and RadGen Media, LLC, a Pennsylvania limited liability company (“RadGen,” “we,” “us,” or “our”), governing your access to and use of the Radically Genuine Podcast website located at https://radicallygenuine.com (the “Site”), the Radically Genuine Podcast, and all related content, membership programs, newsletters, films, community features, events, and services we offer (collectively, the “Services”).
By accessing the Site, subscribing to a membership, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old to create an account, purchase a membership, or participate in community features or events. By using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
3. Important Disclaimer — Not Medical, Psychological, or Professional Advice
Please read this section carefully. All content provided through the Services — including podcast episodes, after-shows, members-only episodes, question-and-answer sessions, films, documentaries, newsletters, articles, community discussions, and events — is provided for general informational, educational, and entertainment purposes only.
Nothing in the Services constitutes medical, psychological, psychiatric, therapeutic, legal, or other professional advice, diagnosis, or treatment. No content is a substitute for individualized advice from a qualified professional who is familiar with your specific circumstances.
No clinician-patient relationship. Although hosts, guests, or contributors may hold professional licenses or credentials, your use of the Services — including membership at any tier, participation in question-and-answer sessions, submission of content recommendations, or attendance at events or retreats — does not create a doctor-patient, psychologist-patient, therapist-client, or any other professional or fiduciary relationship between you and RadGen or any host, guest, or contributor. Question-and-answer sessions address topics of general interest and are not consultations, assessments, or treatment.
Do not disregard professional advice. Never disregard professional medical or mental-health advice, delay seeking it, or discontinue or change any medication or treatment because of something you heard or read through the Services. Decisions about medication and treatment should be made only in consultation with a qualified professional, and some medications can be dangerous to stop abruptly.
Emergencies. If you believe you may be experiencing a medical or mental-health emergency, call your local emergency number or go to the nearest emergency department immediately. In the United States, you can call or text 988 for the Suicide & Crisis Lifeline. Do not use the Services to seek emergency help; community features are not monitored for crisis situations.
Opinions. The views expressed by hosts, guests, and contributors are their own opinions, offered as part of public commentary and debate on matters of public concern. They do not necessarily reflect the views of RadGen Media, LLC, and guest appearances do not constitute endorsements of guests’ views, products, or services.
4. Membership Program
4.1 Tiers. We offer paid membership tiers, currently “Community” and “Inner Circle,” whose benefits, content, and pricing are described on the Site at the time of purchase. Benefits differ by tier. We may add, modify, retire, or substitute particular benefits or content offerings from time to time, provided that the membership continues to offer substantially comparable overall value.
4.2 Billing and automatic renewal. Memberships are subscriptions billed in advance on a recurring monthly or annual basis, depending on the plan you select. By subscribing, you authorize us (and our payment processor) to charge your payment method on a recurring basis at the then-current rate for your plan, plus applicable taxes, until you cancel. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
4.3 Cancellation. You may cancel at any time through your account settings on the Site or by contacting us via the contact page linked at the bottom of our website. Cancellation takes effect at the end of your current billing period; you will retain access to member benefits until then. We do not provide prorated refunds for partial billing periods except where required by law.
4.4 Refunds. Except as required by applicable law or as expressly stated on the Site, membership fees are non-refundable. If you believe you were charged in error, contact us via the contact page linked at the bottom of our website within 30 days of the charge.
4.5 Price changes. We may change membership pricing prospectively. We will provide notice of any price change at least 30 days before it takes effect, and the new price will apply beginning with your next renewal after the notice period. If you do not agree to a price change, you may cancel before it takes effect.
4.6 Founding Member pricing. Promotional “Founding Member” rates, where offered, remain in effect for as long as the member maintains a continuous, active subscription in the applicable tier. Founding rates are personal to the subscribing member, are not transferable, and lapse permanently if the subscription is cancelled, terminated for violation of these Terms, or interrupted by non-payment.
4.7 Access, not ownership. A membership provides access to content and benefits during your active subscription. It does not transfer ownership of any content, and access to members-only content ends when your membership ends.
4.8 Account sharing. Memberships are for individual, personal, non-commercial use. You may not share account credentials or provide access to members-only content to non-members.
5. Events and Retreats
Certain tiers include invitations, priority registration windows, or member pricing for live events and retreats. Unless expressly stated otherwise on the Site, events and retreats are separately ticketed and separately priced; membership provides eligibility and priority, not attendance. Each event or retreat may be subject to additional terms, registration requirements, capacity limits, waivers, and cancellation policies presented at registration, which will govern that event. Events and retreats are educational and community gatherings; they are not therapy, treatment, clinical retreats, or professional consultations of any kind.
6. Member Submissions, Recommendations, and Community Content
6.1 Your content. The Services may allow you to post comments, submit questions for question-and-answer sessions, suggest topics or content, vote in polls, and otherwise submit material (“Submissions”). You retain ownership of your Submissions.
6.2 License to us. By making a Submission, you grant RadGen a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, adapt, publish, distribute, publicly perform, and display your Submission (in whole or in part) in connection with the Services and our media productions, in any media now known or later developed — including reading, discussing, or responding to your Submission in podcast episodes, members-only episodes, question-and-answer sessions, newsletters, and promotional materials.
6.3 Attribution. If we feature your Submission in content (for example, a members-only episode built around a member’s recommendation), we may identify you by the first name or username associated with your account unless you request otherwise at the time of submission or in your account settings. We will not disclose your full name, contact information, or other personal details in content without your separate consent.
6.4 Your responsibilities. You represent that you own or have the necessary rights to your Submissions, and that they do not violate any law or the rights of any person. Do not include personal health information, or private information about yourself or others, in Submissions; Submissions are not confidential and may be visible to other members or the public.
6.5 Community conduct. You agree not to post or transmit content that is unlawful, defamatory, harassing, threatening, hateful, obscene, or invasive of another’s privacy; that constitutes spam or unauthorized advertising; that provides or solicits medical or psychological advice directed at specific individuals; that impersonates any person; or that infringes any intellectual property right. We may, in our discretion, remove content, restrict features, or suspend or terminate accounts that violate these standards, with or without notice.
7. Intellectual Property
The Services and all content we provide — including podcast episodes, after-shows, members-only episodes, films, documentaries, newsletters, articles, artwork, logos, trademarks, and the “Radically Genuine” and “RadGen” names and marks — are owned by RadGen Media, LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view content made available to you for personal, non-commercial use. You may not copy, download (except where a download function is provided), record, reproduce, distribute, publicly display, publicly perform, republish, or create derivative works from members-only or other Site content without our prior written permission. Sharing brief excerpts of public episodes with attribution for commentary or review is permitted consistent with applicable fair-use principles.
8. Third-Party Platforms and Links
The Services may be provided through or linked with third-party platforms (such as podcast directories, membership platforms, payment processors, video hosts, and social media). Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for third-party platforms, their availability, or their content. Links to third-party websites do not constitute endorsements.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy at https://radicallyenuine.com/privacy-policy. By using the Services you consent to that collection and use.
10. Disclaimer of Warranties
The Services and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any content is accurate, complete, or current. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by law, RadGen Media, LLC and its members, managers, officers, employees, hosts, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to the Services or these Terms. To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless RadGen Media, LLC and its members, managers, officers, employees, hosts, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your Submissions, your use of the Services, or your violation of these Terms or of any law or third-party right.
13. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms, engage in conduct that harms other members, our team, or the community, or where we reasonably believe suspension or termination is necessary to protect the Services or comply with law. If we terminate your paid membership without cause, we will refund the prorated unused portion of any prepaid period. If we terminate for your violation of these Terms, no refund is owed. Sections that by their nature should survive termination — including Sections 3, 6.2, 7, and 10 through 16 — survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be brought exclusively in the state or federal courts located in Chester County, Pennsylvania (or the federal district encompassing it), and you and RadGen each consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum. Either party may bring an individual claim in small-claims court where jurisdictional requirements are met. To the extent permitted by law, any claim must be brought within one (1) year after it accrues.
15. Changes to the Services or These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Site with a new effective date and, for active members, by email or notice through the membership platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and may cancel your membership.
16. General
These Terms, together with the Privacy Policy and any additional terms presented for specific offerings (such as events or retreats), are the entire agreement between you and RadGen regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to us should be sent to the contact below.
